Federal Court Rules – FTC And Blogging

On December 1, 2009, the internet marketing world will change. It will change for the better for some and for others, it will change for the worst. The new FTC laws will take effect. This is the first time in the history of the internet that the FTC has taken such a heavy hand in regulating what is said, sold and conduct online.

These laws will put many out of business, put in jail, fined thousands of dollars and bank assets frozen. What can you do now to avoid being prosecuted? It is simple; get your entire websites in compliance now. Get your business plans in order. Get your documentation to back up your claims and endorsements in order.

It only takes one compliant for the FTC to come knocking. If you aren’t prepared, it can go badly for you. Getting in compliance is easy, staying there is hard. Laws will change and become more defined. Court findings that did not affect you December 1st, may affect you in the future. It is going to be a very tough year to do business, but if you are ethical in your business dealings and have adequate documentation to back up every single word on your blog or website, then you will have nothing to worry about. For the longest time the federal government did not pay a lot of attention to the internet. It was new to them and the federal government really did not know much about it or its potential. Blog Disclaimers – Do You Really Need One?

Blog Disclaimers come on all shapes and sizes. You may see a huge ten page long disclaimer on one site and then on another site you may see a very short one page disclaimer. Which one do you think is the better, the website with the long disclaimer or website with the short disclaimer? Actually they might both be OK. It all depends on the kind of internet business you are conducting and that is what dictates the appropriate disclaimers.

Some sites are only for personal information. They use their blog like a diary. They are not selling anything, but their words could potentially endorse something they used or referred to a friend. Now in most cases that would not get someone in trouble, but if your blog has a lot of traffic, you could potentially run into legal problems. In this case a short version of a blog disclaimer is appropriate.

Most bloggers that don’t sell anything usually find a good disclaimer on someone’s site and grab it for their own. They are content with the wording and really have no need to monitor the changes in the law. Read the rest of this entry

Is using legal forms online the same as using an attorney? It is good question and in most situations one will work better versus the other. But which one do you start with?

When you are first starting out in your own business or even in a partnership you start to wonder when it is the best time to start using attorneys? It is a wonderful question to ask, because you are going to get a different answer from everyone you ask. Some are going to answer the question with the mindset of liability. Others will answer the question with the mindset of taxation and still others will have their own ideas of why and when to use an attorney versus legal software forms.

That leaves you with very little to go forward with and not much to support any conclusions on when to start. I came through this same ordeal myself. I asked my accountant who gave me one answer and then a friend who was a successful in real-estate who answered the question differently; that left me still guessing.
